What happens next?

Once we’ve discussed your circumstances, we’ll be able to decide straightaway whether we can help. If we think you’ve got grounds for a claim, we’ll find a solicitor that specialises in your claim area and who can take your claim forward. Don’t worry – there are no hidden costs. Your solicitor will work on a ‘no win no fee’ basis so you won’t lose a penny, whatever the outcome.

During your free consultation, you will be asked some questions about the accident and any injuries that you have suffered as a result. The solicitor will then draw up a Letter of Claim based on this discussion and send it to the defendant that you wish to claim against. The Letter itself informs the defendant of your official intent to claim for the injuries caused by something that you feel was their fault.

The solicitor may then instruct a medical professional to formally assess your injuries and prepare a Schedule of Losses which includes all the resulting financial losses that you wish to claim for. This will then be sent to the defendant with a request for them to pay.

From here, it then depends if the person we’re making the claim against admits liability or not. The next section claim resolution will explain this further.

Claim Resolution

There are 4 possible outcomes to your claim against the defendant:

Claim Accepted

The defendant acknowledges responsibility for the claim and accepts blame. The solicitor negotiates a fair compensation settlement based on this and you are paid the compensation and solicitor’s costs that are due.

Claim Disputed

The defendant disputes the claim you have made against them. Negotiation is therefore required. Hopefully a mutually agreeable settlement can be reached. If not, the case will need to go to Court, and you will be represented by the solicitor. The Court will independently make a decision on your claim.

Case Won

The Court will decide that you are entitled to compensation based on your claim. The Court will instruct the defendant to pay an amount that is either agreed or fixed by the Court, plus any solicitor’s costs incurred.

Case Lost

The Court will decide that you do not have grounds for compensation based on your claim. You will not be paid anything. Claims Justice and its panel of solicitors work on a NO WIN, NO FEE, NO RISK basis ensuring that if your claim fails it will not cost you a penny.
